Terms & Conditions of Sale
The terms that apply to every order you place with us — how your cards are proofed and made, what you pay, and the rights you have.
Business Engrave (a trading name of Archivistry B.V.)
In force from 4 October 2026
Article 1 — Who we are and how to reach us
1.1 These Terms and Conditions of Sale (the “Terms”) apply to every offer we make and every contract we conclude at a distance with a customer through our website https://businessengrave.com (the “Website”).
1.2 Our details:
- Legal entity: Archivistry B.V. (“we”, “us”, “our”)
- Trading name: Business Engrave
- Registered office, postal address and returns address: Jonkheer Ruysstraat 67, 6221 VS Maastricht, the Netherlands
- Chamber of Commerce (KvK) number: 42067335
- Dutch VAT identification number (btw-id): NL869557221B01
- Email: team@businessengrave.com
- Telephone: +31 6 26 48 62 12
- Website: https://businessengrave.com
1.3 Email is the fastest way to reach us. We aim to answer every email within one business day. We do not operate fixed telephone hours; if we are unable to take your call, or if you ask us to call you back through the Website, we will call you back, usually within one business day. In every case we will respond substantively to a complaint within the periods set out in Article 14.
1.4 Our Shipping & Delivery policy and our Returns, Refunds & Cancellations policy, both published on the Website, form an integral part of these Terms. Where any of those documents appears to conflict with these Terms, these Terms prevail.
Article 2 — Definitions
In these Terms the following words have the following meanings:
- Consumer: a natural person who is not acting for purposes relating to their trade, business, craft or profession.
- Business customer: a natural or legal person who is acting for purposes relating to their trade, business, craft or profession.
- Customer / you: the consumer or business customer who concludes a contract with us.
- Product: any item offered on the Website — currently laser-engraved business cards in metal (stainless steel and black aluminium) and wood (walnut, oak and bamboo).
- Design service: our custom design service, described in Article 7.
- Artwork: the logos, images, text, QR-code destinations and any other material or details you supply to us for your order.
- Proof: the digital proof of your design that we send you for approval before production begins, described in Article 6.
- Cooling-off period: the period within which a consumer may exercise the right of withdrawal.
- Durable medium: any means (including email and PDF) that allows you to store information addressed to you personally in a way that is accessible for future reference and permits unaltered reproduction.
- Day: calendar day, unless the text says “business day”.
Article 3 — Applicability of these Terms
3.1 These Terms apply to every offer on the Website and to every distance contract concluded between us and you.
3.2 Before the contract is concluded, the text of these Terms is made available to you electronically on the Website, in a way that allows you to store it and reproduce it unaltered. You may also request a free copy by email or by post at any time.
3.3 If any provision of these Terms is void, annulled or unenforceable, the remaining provisions remain in full force. The provision concerned is replaced by a valid provision that approximates its purpose as closely as possible.
3.4 Nothing in these Terms limits or excludes your mandatory rights as a consumer. Where a provision conflicts with a mandatory rule of Dutch consumer law, or of the law of your country of habitual residence, that mandatory rule prevails.
3.5 We sell primarily to businesses, but consumers are equally welcome to order. Provisions that are stated to apply to consumers — in particular the right of withdrawal in Articles 11 and 12 and the consumer guarantees in Article 13 — do not apply to business customers.
Article 4 — Products, offers and accuracy
4.1 Every offer on the Website contains a description that is sufficiently detailed for you to assess the product properly, makes clear that the product is engraved to your specification, and states the price in accordance with Article 8.
4.2 Images are as accurate a representation as we can achieve. Our products are made from natural materials and metals: variation in wood grain, colour, figure and finish between individual items, and in the tone and finish of metal surfaces, is inherent to the material and is not a defect. This does not affect your rights under Articles 11 and 13.
4.3 Our products are made to order. Each card is laser-engraved and finished individually or in small batches. As a result, no two items are exactly identical. Minor differences may occur in engraving depth and tone, positioning and alignment, dimensions, edge finish and surface texture — including between items within the same order, between a repeat order and an earlier one, between the item you receive and the images shown on the Website, and between the on-screen appearance of your proof and the physical engraving, whose tone depends on the material. Such minor variations are inherent to the way our products are made and are not a defect. This does not affect your rights under Articles 11 and 13.
4.4 An offer applies only for the period stated on the Website and while the material concerned is available.
Article 5 — Orders and how the contract is formed
5.1 The contract is concluded at the moment we send you an order confirmation by email. Before you place the order, the Website shows you a summary of your order and gives you the opportunity to correct any errors.
5.2 We may decline an order, or accept it subject to conditions, where the product or material is unavailable, the delivery address cannot be served, payment fails, Article 16.5 applies, or we have reasonable grounds to suspect fraud or misuse. If we decline an order for which you have already paid, we refund the full amount within 14 days.
5.3 If anything goes wrong during the order process — a wrong address, a mistyped name or telephone number, the wrong material or option selected, a duplicate order — please contact us as soon as you possibly can by email. The sooner you reach us, the more likely it is that we can still put it right before you approve your proof and production begins. We will always do what we reasonably can to remedy the issue.
5.4 You are responsible for providing a correct and complete email address and delivery address. Please check the order confirmation on receipt and tell us immediately if anything is wrong.
5.5 We archive the text of every contract. You may request a copy from us at any time.
Article 6 — Your proof and approval
6.1 Every order is engraved to your specification. After you place your order, we prepare a digital proof showing how your product will be engraved, based on the details, options and Artwork you have provided, and send it to you for approval.
6.2 Nothing is engraved until you have approved the proof. Please check it carefully — in particular names, job titles, telephone numbers, email and web addresses, QR-code destinations, spelling, layout and material. If anything needs correcting, tell us before you approve the proof and we will send you a revised one.
6.3 The approved proof is the specification of your order. We engrave the design exactly as shown in the proof you approved, including spelling, capitalisation, spacing, punctuation, numbers and QR-code destinations. We do not correct, alter or verify its content after approval. You are responsible for the accuracy of the content you approve, and we accept no liability for errors in it.
6.4 If you notice a mistake after approving your proof, contact us at team@businessengrave.com as soon as possible. We will amend it if we are able to do so, but only if we receive your message before production of your order has begun. Once production has begun, no changes are possible.
6.5 Because our products are made to your specification, a consumer’s right of withdrawal ends once production has begun. Production only begins after you approve the proof, so until then a consumer may cancel the order free of charge (see Article 11). Once production has begun, the order cannot be cancelled or returned, except where the product is faulty, damaged or does not match the approved proof (see Article 13).
Article 7 — Custom design service
7.1 If you order our design service, we design your card for the flat fee shown on the Website. We revise the design as many times as needed until you approve it; revisions are included in the fee.
7.2 The design you approve becomes the proof for your order, and Article 6 applies to it in full.
7.3 If you are a consumer, you may cancel the design service at any time until you approve the final design, and we will refund the design fee in full in accordance with Article 12. This does not limit any statutory right of withdrawal you may have.
7.4 Article 16.6 sets out what you may do with the design we create for you.
Article 8 — Prices, VAT and import charges
8.1 All prices are shown in euros (EUR). Prices on the Website are shown excluding VAT and excluding delivery. VAT, where due, is calculated at checkout on the basis of your delivery address, and the cost of the delivery option you choose is added. Both are shown to you at checkout, before you commit to payment, and the total shown there is the amount you pay.
8.2 The price shown at the moment you place your order applies to that order. Price changes after that moment do not affect it.
European Union
8.3 Orders delivered within the European Union are not subject to customs formalities. The total shown at checkout is the total amount you pay: no further VAT, customs duty or handling fee arises on delivery anywhere within the EU.
8.4 Northern Ireland. Under the Windsor Framework, Northern Ireland continues to follow EU rules for goods. Orders delivered to Northern Ireland (BT postcodes) are therefore not subject to customs formalities, and no import VAT, customs duty or carrier handling fee arises on delivery.
United Kingdom (England, Scotland and Wales), Switzerland, Norway, Iceland and Liechtenstein
8.5 These countries are outside the customs territory of the European Union. Import VAT, customs duties and carrier handling or clearance fees may be charged by the authorities of the destination country or by the carrier when your order arrives. Any such charges are payable by you as the recipient, and are separate from the amount you pay us at checkout.
8.6 You are encouraged to check, before ordering, what taxes and import duties are payable in your country. It is entirely the responsibility of the recipient of the order to establish which charges may be incurred on import and to pay them accordingly. We cannot calculate, predict, absorb or refund them.
8.7 Customs handling fees. Please also be aware that a customs handling or clearance fee may be charged in addition to any tax, either by the carrier or under local regulations, and is not under our control. This fee can be relatively high regardless of the value of your order and, on a small order, may represent a substantial proportion of what you paid. Please take this into account before you order.
8.8 If a parcel is returned to us or destroyed because import charges were not paid or the parcel was not collected, Article 10.10 applies.
8.9 Summary of the treatment by destination:
| Destination | What we charge | What you may still have to pay |
|---|---|---|
| EU member states | The price, delivery and any VAT due, shown at checkout | Nothing further |
| Northern Ireland (BT) | The price, delivery and any VAT due, shown at checkout | Nothing further |
| United Kingdom (England, Scotland, Wales), Switzerland, Norway, Iceland, Liechtenstein | The price, delivery and any VAT due, shown at checkout | Any import VAT and duties, plus a customs handling fee that can be high relative to the order value |
Article 9 — Payment
9.1 Payment is processed at checkout by Stripe. The payment methods available to you are those displayed at checkout at the time you place your order.
9.2 Payment is due in full when the order is placed. We do not accept partial payment.
9.3 We never see or store your full card details. Stripe processes and stores payment data; see our Privacy & Cookie Policy and Stripe’s own privacy notice.
9.4 Retention of title. Ownership of a product passes to you when we have received payment in full. Risk of loss or damage passes separately, in accordance with Article 10.8.
Article 10 — Production, delivery and risk
10.1 We deliver to the address you provide at checkout. The countries we ship to and the delivery options available are set out in our Shipping & Delivery policy.
Production
10.2 Production begins once you have approved your proof. Production normally takes 3 to 5 business days from your approval.
10.3 Larger batches and complex designs may take longer. Where that is the case, we will confirm the expected timeline with you.
Delivery
10.4 You choose between two delivery options at checkout: Tracked Delivery, which is insured and tracked and normally takes 3 to 5 working days after dispatch, and Express Courier, which normally delivers on the next working day across most of the EU. These transit times depend heavily on the carrier’s capacity, the destination, customs inspections, force majeure and other external factors outside our control.
10.5 The overall time until delivery therefore depends on when you approve your proof, on production and on transit. The figures above are indications only. Delays can and do occur, and these figures are not guaranteed delivery dates.
10.6 In every case, and regardless of the indications above, we will deliver within 30 days of the conclusion of the contract unless a longer period has been expressly agreed with you in advance. Where we are waiting for your approval of the proof, or for information or Artwork that we need from you, that period is extended by the time we are waiting.
10.7 If we cannot meet the agreed delivery period we will tell you as soon as we become aware of it. You may then set a reasonable additional period for delivery. If we fail to deliver within that additional period, you may rescind the contract without cost and we will refund everything you have paid within 14 days. Where delivery within the original period was essential and you told us so, or where that is clear from the circumstances, you may rescind immediately.
Risk and failed delivery
10.8 Risk of loss or damage in transit lies with us until you, or a third party you have designated other than the carrier, take physical possession of the goods (for consumers, Article 7:11 of the Dutch Civil Code; we apply the same rule to business customers). If your parcel is lost, stolen or damaged in transit, contact us and we will remake and resend your order or refund you in full. We do not pass carrier failures on to you.
10.9 If delivery fails because the address you gave was incorrect or incomplete, or because the parcel was not collected within the carrier’s retention period, we may charge you the actual cost of re-dispatch.
10.10 If a parcel is returned to us undelivered for a reason within your control — including an incorrect address, a parcel that was not collected, or import charges that were not paid — we will hold it for 30 days and contact you about re-dispatch at your cost. Because the product is made to your specification, no refund is due; if we have not heard from you within that period, we may dispose of the item.
10.11 Where an order contains several items, we may deliver them separately at no extra cost to you.
Article 11 — Right of withdrawal and cancellation (consumers)
11.1 As a consumer buying at a distance, you normally have a statutory right to withdraw from the contract within 14 days without giving any reason. That right does not apply to goods made to the consumer’s specifications or clearly personalised (Article 6:230p under f of the Dutch Civil Code and Article 16(c) of Directive 2011/83/EU). Every product currently offered on the Website is engraved to your specification — with your name, company details, logo or other Artwork — and falls under that exception once production has begun.
11.2 You can cancel free of charge until you approve your proof. Production only begins after you approve the proof. Until then you may cancel your order, without giving any reason, and we will refund everything you have paid, including the delivery cost, in accordance with Article 12.
11.3 Once you have approved your proof and production has begun, the order can no longer be cancelled, returned or refunded, because the product is produced to the specific requirements of your order and has no resale value to us. We make this clear on our product pages and in these Terms. If we have failed to give you that information before you placed your order, the full 14-day right of withdrawal applies to your order despite this Article.
11.4 The absence of a right of withdrawal after approval does not affect Article 13. You are always entitled to a remedy if a product is defective, damaged, or does not match the proof you approved.
11.5 If we have not informed you of the right of withdrawal where it applies, the cooling-off period is extended by twelve months. If we provide that information during those twelve months, the period ends 14 days after the day you receive it.
11.6 Business customers do not have a statutory right of withdrawal. If you need to change or cancel a business order before you approve the proof, please contact us as soon as possible and we will do what we reasonably can.
Article 12 — How to cancel, and refunds
12.1 To cancel, tell us by any unambiguous statement. You may email team@businessengrave.com, use the model withdrawal form in Annex I, or write to our postal address. You do not need to give a reason.
12.2 We confirm receipt of your cancellation without delay, on a durable medium.
12.3 Refunds. We refund you within 14 days of receiving your cancellation, using the same means of payment you used, unless you expressly agree otherwise. Refunds are free of charge. Where you cancel before approving your proof, nothing has been made or dispatched, and we refund everything you have paid — the price, any VAT, any design fee and the delivery cost.
Article 13 — Conformity and the statutory guarantee
13.1 We guarantee that our products conform to the contract — including the proof you approved — to the specifications stated in the offer, to reasonable requirements of soundness and usability, and to the statutory provisions in force on the date the contract is concluded (Article 7:17 of the Dutch Civil Code). Because our products are made from natural materials and metals, their soundness, usability and appearance over time depend on their being used for their intended purpose and cared for properly. Reasonable requirements of soundness and usability are therefore assessed on the basis of normal use and proper care of the product. This guarantee does not extend to defects or deterioration resulting from improper or unintended use, failure to follow any care or use instructions we supply, neglect, cleaning with unsuitable products, exposure to moisture, heat, prolonged direct sunlight or extreme conditions, accidental damage, or alteration or repair by anyone other than us; nor to normal wear and tear or to the natural variation described in Articles 4.2 and 4.3.
13.2 Conformity is judged against the proof you approved. A product that matches your approved proof conforms to the contract, even if the approved content contains a spelling mistake, a wrong name, an outdated telephone number or a QR code pointing to the wrong address. That is not a fault, a defect or an incorrect delivery. A product is faulty, damaged or incorrect only where the shortcoming is ours — for example the engraving does not match the approved proof, the wrong product or material was sent, the item arrived damaged, or the material or workmanship is defective.
13.3 For consumers, this is your statutory guarantee. There is no fixed expiry date: you are entitled to expect a product to last as long as is reasonable given its type, price, description and normal use. In any event, a lack of conformity that appears within two years of delivery is covered. No commercial guarantee we or a third party may offer limits these rights.
13.4 If a lack of conformity appears within one year of delivery to a consumer, it is presumed to have existed at delivery unless we prove otherwise (Article 7:18a of the Dutch Civil Code). After that first year, we may ask you to show that the defect was present at delivery.
13.5 Remedies. As a consumer, you may require free repair or replacement — for an engraved product this normally means that we remake it — and you may choose between them unless your choice is impossible or would impose disproportionate costs on us. If repair or replacement fails, is refused, is not carried out within a reasonable time, or causes you significant inconvenience, you may claim a proportionate price reduction or rescind the contract and receive a refund. You bear no cost — shipping, labour and materials are ours.
13.6 Please report a lack of conformity within a reasonable time of discovering it. For consumers, notice given within two months of discovery is always regarded as timely.
13.7 Business customers. Articles 13.3, 13.4 and the second sentence of 13.6 apply to consumers only. A business customer must report a lack of conformity within a reasonable time after discovering it or after it should reasonably have been discovered (Article 7:23 of the Dutch Civil Code). Where a product delivered to a business customer is faulty, damaged in transit or does not match the approved proof, we will remake it or refund what you paid for it, at no cost to you.
13.8 How to make a claim: email team@businessengrave.com with your order number, a description of the problem and, if possible, photographs. We compare the product with your approved proof and will respond substantively within 14 days.
Article 14 — Complaints and disputes
14.1 We would much rather put something right than have you dissatisfied. Please send complaints to team@businessengrave.com, describing the issue fully and clearly, within a reasonable time of discovering it.
14.2 We acknowledge complaints within 5 business days and give a substantive response within 14 days. If we need longer to investigate, we will say so within that period and tell you when you can expect a full answer.
14.3 Consumers in the Netherlands can obtain free information and advice from ConsuWijzer, the consumer information desk of the Dutch Authority for Consumers and Markets (ACM), at consuwijzer.nl. Consumers elsewhere in the EU, and in Norway and Iceland, can obtain free help from their national European Consumer Centre (ECC-Net).
14.4 Making a complaint does not suspend our obligations unless we confirm otherwise in writing, and it does not affect your right to bring the matter before a court.
Article 15 — Liability and force majeure
15.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, for product liability under Article 6:185 of the Dutch Civil Code, or for any other liability that cannot lawfully be excluded or limited.
15.2 Subject to Article 15.1, our liability is limited to loss that was reasonably foreseeable at the time the contract was concluded and, in any event, to the invoice value of the order concerned. We are not liable for indirect or consequential loss, or for loss of profit, revenue or data.
15.3 We are not liable for damage arising from use of a product contrary to any instructions or care guidance we supply with it.
15.4 Force majeure. We are not liable for any failure or delay in performing our obligations that results from circumstances beyond our reasonable control, including natural disaster, war, civil unrest, epidemic, strike, fire, flood, failure of public infrastructure or telecommunications, government measures, customs action, or the failure of a supplier or carrier for the same reasons. We will inform you promptly. If the situation lasts longer than 60 days, either of us may rescind the contract, and we will refund all amounts you have paid for goods not delivered, within 14 days.
Article 16 — Intellectual property and your Artwork
16.1 All content on the Website — texts, illustrations, photographs, designs, templates, typography and logos — is protected by the Dutch Copyright Act (Auteurswet), the Benelux Convention on Intellectual Property and international treaties, and is owned by or licensed to Archivistry B.V.
16.2 Reproduction, distribution, adaptation or commercial exploitation of that content, in whole or in part, is not permitted without our prior written consent, save within the statutory exceptions such as private copying and quotation (Articles 15a and following of the Auteurswet).
16.3 Purchasing a product does not transfer any of our intellectual property rights to you, except as set out in Article 16.6. You may of course use the products you buy for their intended purpose, including handing them out in the course of your business.
16.4 Your Artwork remains yours. You keep all rights in the Artwork you supply. You allow us to use, reproduce and adapt it solely to prepare your proofs and to produce and deliver your order.
16.5 You warrant that you are entitled to use any logos, trade marks, images, text or other Artwork you supply to us, and that its use for your order does not infringe the rights of any third party. You indemnify us against third-party claims arising from Artwork you have supplied. We may decline to produce any item where the Artwork submitted appears to us to infringe third-party rights or to be unlawful or offensive.
16.6 Designs we create for you. Once you have paid for the design service in full, you may use the final design we created for you, without further charge, for any purpose of your business — including reproducing it on other products and materials. Your rights in any Artwork it incorporates are unaffected.
16.7 Infringement of our intellectual property rights may give rise to civil proceedings for damages and injunctive relief under Dutch and EU law and, in serious cases, to criminal prosecution under Articles 31 and following of the Auteurswet.
Article 17 — Personal data
17.1 We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Dutch GDPR Implementation Act (UAVG). The controller is Archivistry B.V., at the address given in Article 1.2.
17.2 Our Privacy & Cookie Policy explains what data we collect, why, on what legal basis, who we share it with, how long we keep it and what rights you have.
17.3 You may lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl) or with the supervisory authority in your own country.
Article 18 — Age and capacity
18.1 By placing an order you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian to enter into the contract.
18.2 We may decline any order where we have reasonable grounds to doubt this.
Article 19 — Changes to these Terms
19.1 We may amend these Terms from time to time. The version in force at the moment you place your order governs that order. Changes never apply retroactively to contracts already concluded.
19.2 The date from which this version applies appears at the top of this document. Previous versions are available from us on request.
Article 20 — Applicable law and competent court
20.1 These Terms and every contract concluded under them are governed by Dutch law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
20.2 If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of that country (Article 6 of Regulation (EC) No 593/2008, “Rome I”).
20.3 Disputes may be brought before the competent court in the Netherlands in the district where Archivistry B.V. has its registered office. A consumer resident in the European Union may always bring proceedings before the courts of their own country of domicile, and we will bring proceedings against such a consumer only before the courts of that country (Regulation (EU) No 1215/2012, “Brussels I recast”).
20.4 Disputes with business customers are submitted to the competent court in the Netherlands in the district where Archivistry B.V. has its registered office.
Annex I — Model withdrawal form
Complete and return this form only if you are a consumer and wish to withdraw from the contract. You are not obliged to use it: any unambiguous statement will do, as long as it contains your name and your order number.
